Terms of service

1. Parties

These terms govern use of Dawbrain, operated by Alon Amsellem (individual, based in Israel). "We", "us", and "Dawbrain" refer to Alon Amsellem; "you" refers to the user of the service.

2. Service

Dawbrain is an AI-powered chat assistant that integrates with Ableton Live via a local agent and a browser-based chat UI. The service depends on third-party AI providers (currently Anthropic) and may be affected by their availability.

3. Eligibility

You must be at least 18 years old to use Dawbrain, or have parental consent if younger. You must provide accurate account information.

4. Acceptable use

You must follow the Acceptable Use Policy. In short: no illegal content, no harassment, no attempts to jailbreak the AI system or extract internal prompts, no using Dawbrain to train competing AI models, no automated scraping.

5. Intellectual property

We retain all rights in Dawbrain itself: the software, brand, and content. Outputs generated by the AI in response to your prompts are yours to use, subject to the upstream AI provider's terms (Anthropic's usage policies apply).

6. Subscription and billing

Paid subscriptions are billed monthly through Lemon Squeezy, our merchant of record. Lemon Squeezy collects and remits VAT, sales tax, and similar charges based on your billing address. Prices are displayed in USD; Lemon Squeezy may show a local currency at checkout.

Subscriptions auto-renew until cancelled. You can cancel from the app at any time; access continues through the end of the current billing period.

7. Refunds

Online consumer purchases are subject to a 14-day right of withdrawal under Israel's Consumer Protection Law 5741-1981. Refund handling is operated via Lemon Squeezy; see the refund policy for details.

8. Termination

Either party may terminate at any time. We may suspend or terminate accounts for violations of these terms. On termination, your access ends; data retention follows the privacy policy.

9. Warranties and limitation of liability

Dawbrain is provided "as is", without warranties of any kind. We don't guarantee that AI responses are accurate, safe, or suitable for your specific creative work. You apply our suggestions at your own risk.

To the maximum extent permitted by law, our total liability for any claim relating to the service is limited to the fees you paid in the twelve months preceding the claim. Nothing in these terms limits liability for intent or gross negligence, or where Israeli consumer law prohibits such limits.

10. Governing law and jurisdiction

These terms are governed by the laws of Israel. Exclusive jurisdiction for any dispute lies with the competent courts of Tel Aviv, Israel.

11. Changes

Material changes to these terms will be announced at least 30 days before they take effect. Continuing to use the service after that date constitutes acceptance.
